Terms and Conditions

This page details the current terms and conditions for Belov Photography. When booking a session, you agree to these terms upon paying your booking fee. 

 

1. Definitions

An agreement is defined as a “contract for services”. This agreement is between Belov Photography (“the Photographer”) and [You] (“the Client”). References to “Image (s)” refers to photographic material, whether still or moving, created by the Photographer pursuant to this Agreement and includes, but is not limited to, prints, transparencies, digital files or any type of electronic material.  

2. Usage rights, ownership and copyright

The 1998 Copyright, Designs, and Patents Act (http://www.legislation.gov.uk/ukpga/1988/48/contents) (“the Act”) assigns copyright to Belov Photography.  The Photographer asserts their statutory rights to be credited as the author of the Photos in accordance with sections 77 and 78 of the Act and any amendments or re-enactments thereof.  The Photographer always retains full copyright of all photographs and retains the right in all cases to use any photographs in any manner at any time to advertise or promote their work.

3. Social media and personal websites. 

Images may only be used and shared (e.g. on social media, blogs, or, but not limited to, other online channels) once payment has been fully completed. The client agrees to credit “Belov Photography” and share details of the website (www.belovphotography.co.uk) and link to social media pages (Facebook / Instagram). Web-sized images will be shared with a watermark crediting the Photographer. This must remain intact and visible. Please note that web-sized Images are not suitable for printing, nor is it permitted under the 1998 Copyright Act. 

Any previews of the Images, such as via access to an online gallery, must not be copied, screen shot, or edited in any way. 

4. Payment

Payment for the booking fee and total cost can be made via a combination of direct bank transfer, Pay Pal, and or cash. Payments for any additional purchases (prints, session length etc) are to be made at time of initial order via direct bank transfer, Pay Pal, and or Cash. Any requests for additional services / purchases made at the time of the session, will be subject to availability. 

5. Booking Fee

A flat rate deposit fee of £50 is required at the time of booking to reserve the session. This fee is non-refundable unless the cancellation is made by the Photographer (please see details below). This covers the time spent to arrange the booking, plan the session and any questions in the lead up to the session. Please note that your session timing is not confirmed until the fee is received by the Photographer. 

6. Travel cost

If the requested photoshoot location falls outside of zones 1-5, an additional fee will be applied to cover the Photographer’s increased travel time and costs. This travel fee must be paid along with the photoshoot booking fee.

7. Balance payment

Remaining balance payment is to be done upon successful completion of the photoshoot session, on the day of the photoshoot. Payment can be made via a direct bank transfer, Pay Pal, and or cash. Any additional requests / products / print-outs etc must be paid for in advance. 

The Photographer generally requests a brief at the time of booking (via email or verbally). Where extra expenses or time are incurred or needed by the Photographer as a result of alterations to the original brief by the Client or otherwise at their request, the Photographer will reserve the right to charge the Client extra expenses and fees

8. Image Processing

The Photographer will provide a curated ‘sneak preview' gallery to the client to select which photos (the number of which will be determined by the purchased package) will be chosen for extensive retouching / alterations (such as removal of backgrounds / individuals). This gallery will be open / available for 7 business days during which time the Client must make their selections. Reopening the gallery after this time will incur a £10 fee. Note, all other photos will only receive basic retouching such as colour balancing, cropping and minor cosmetic alterations. 

The Photographer will have full control over how the images are retouched / processed, based on the style and method chosen by the Photographer and reflective of the style and quality advertised. It is the clients responsibility to make the Photographer be aware any considerations that they want to keep in mind when processing the photos. 

The Photographer reserves the right to use discretion for the best result and to decline edit requests which substantially change the look of an image. 

Unless a rejection fee is agreed in advance, there is no right to reject the Images on the basis of style or composition.

9. Timing

“Sneak preview” gallery will be provided within 7 business days of the Photoshoot. Following selection of photographs by the client, standard photo editing and delivery will be completed within 7 business days. The Client’s photo gallery link will be provided via email once the photos are ready. These online galleries will be available for viewing and downloading by the Client for a period of 1 month from the date of delivery. Clients requiring expedited editing and delivery the next day, an additional agreed upon rush fee will be charged. This fee must be paid in advance before any expedited editing will commence.

10. Rescheduling / Refunds & Cancellations.

If there are unavoidable circumstances that require a rescheduling, then there is an opportunity to reschedule within a 1 month period. 48 hour advance warning must be given. Any new date is subject to the Photographer availability. Cancellation under within under 48 hours of photoshoot session might result in forfeit of booking fee.

11. Raw files

The Photographer will not provide raw, unedited photo files to clients. All photo galleries will contain only the final, edited images selected and processed by the Photographer. Providing raw files is unnecessary as the Photographer carefully edits and curates the best images from each session before delivery

12. Creative license

The Photographer will have full creative and artistic license in relation to locations, poses and number of photos taken (subject to package purchased). Some photographs may not be possible due to changes in weather conditions and the availability and willingness of subjects. The Photographer will do their best to honour requested photographs but does not undertake to guarantee any specific picture nor incorporate any specific background, location or group arrangement.

13. Client obligations

The Photographer cannot be held responsible for any images deemed unsatisfactory if the client has directed elements of the shoot not recommended by the Photographer. This includes location, final image choice, time of shoot and other variables.

The Photographer will not be held responsible for any ruined photographs due to causes outside of the Photographer’s control.

The Client agrees to assist and cooperate with the Photographer to the extent possible, ensuring that all attendees of any photoshoot are appropriately prepared (rested, fed, dressed, styled etc). The Photographer is not responsible if any of the photoshoot participants refusal to cooperate impacts the number and quality of pictures that can be taken. 

The Client agrees that they are responsible for their own and their dependents safety throughout the photoshoot session. It is the Client’s responsibility to inform the Photographer if anyone attending the photography session suffers from any health conditions including allergies, photosensitive epilepsy, medical issues, physical difficulties and disabilities etc.

14. Liability.

In the unlikely event of technical problems, camera/photographic failure, loss of image (s) before delivery to the client is made, injury or sickness beyond the control of the Photographer, their liability shall be limited to a full refund of all monies paid. The Photographer will not be liable for any acts or incidents outside of their control, such as, but not limited to: strikes, accidents, government laws and orders etc. 

15. Data Protection and privacy policy

The Photographer will store Client names, contact details and session information privately and will not share these with any other business or organisation. Should you wish to have your details removed from our database, please advise us in writing or via email. If you have any issues with any image or photograph on the website please get in touch directly in writing or via email. 

16. Image archiving 

The Photographer will keep all images on archive for one month from the date of the photo shoot session, after which they may be permanently deleted. It is the Client responsibility to backup any digital files you receive. Please create multiple backups on different devices, and ensure the safe keeping of any prints, albums or other products.

17. Image permission release

General Data Protection Regulation (GDPR) requires that it is made clear how your images may be used, and that your consent is collected for this use. Either a printed or electronic form will be provided for your signature.
